HOUSE CONCURRENT RESOLUTION NO. 28

Requesting the Joint Committee on Government and Finance to make a study of the population density requirement set forth in section one, article two, chapter eight and other requirements of section four, article six, chapter eight of the code of West Virginia.
WHEREAS, Anexation and the merger of unincorporated property into an existing incorporated city is being used as a productive planning tool for urban development and long range planning; and
WHEREAS, A more regional approach to planning and development is essential to the provision of quality and efficient delivery of essential services to the citizenry of the state of West Virginia; and
WHEREAS, Careful planning will reveal the benefits of annexation, not only for cities but also for counties and regions within the boundaries of West Virginia; and
WHEREAS, Effective use of annexation can result in reducing expense to cities, counties and the state in correcting and improving infrastructure systems while ensuring economic growth;and
WHEREAS, West Virginia's annexation laws are in need of review to; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to review, examine and study the existing law as set forth in section one, article two, chapter eight and other requirements of section four, article six, chapter eight of the code of West Virginia; the need to simplify the procedure used by citizens who petition the city for annexation,; the need to eliminate or reduce the amount of administrative time and funds spent as a result of the population density requirement as set forth in section four, article six, chapter eight; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 1997, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation to be paid from legislative appropriations to the Joint Committee on Government and Finance.
